Summary:The basis for land ownership can be in the form of a Sale Purchase Deed, a Will or a Grant through the transfer of rights to land or goods first. However, the sale and purchase agreement exists as an alternative to buying and selling between the parties, which can be done through a private deed or can also be done through a deed drawn up before a notary. The deed of sale and purchase binding is often referred to in the form of an authentic deed drawn up before an authorized official, either a Notary or a Land Deed Making Officer (PPAT) who has valid evidentiary powers. Every agreement entered into by the parties must be carried out in accordance with their abilities and in good faith, so that all the rights and obligations of each party stipulated in the agreement can be fulfilled perfectly. This is an ideal implementation of the agreement for the parties involved. In the community there are still many problems in the cancellation of the land sale and purchase binding agreement deed and the settlement process. These problems may arise due to differences in interpretation, lack of understanding between one party and another, as well as disputes because one party cannot comply. If the problems in the agreement cannot be resolved by way of deliberation, litigation and alternative dispute resolution, then the settlement of problems in the agreement can be done by canceling the agreement based on the applicable law. Abstrak Dasar kepemilikan tanah bisa di dapat berupa Akta Jual Beli, Wasiat atau Hibah yang melalui pemindahan hak atas tanah atau barang-barang terlebih dahulu. Namun pengikatan jual beli hadir sebagai alternatif jual beli antara para pihak dapat melalui akta dibawah tangan atau dapat pula dilakukan melalui suatu akta yang dibuat dihadapan notaris. Akta pengikatan jual beli sering disebut dalam bentuk akta otentik yang dibuat dihadapan pejabat yang berwenang baik Notaris ataupun Pejabat Pembuat Akta Tanah (PPAT) yang memiliki kekuatan pembuktian yang sah. Setiap perjanjian yang dibuat oleh para pihak harus dapat dilaksanakan sesuai dengan kemampuan dan dengan adanya itikad baik, sehingga segala hak dan kewajiban dari masing-masing pihak yang diatur dalam perjanjian tersebut dapat dipenuhi dengan sempurna. Hal ini merupakan pelaksanaan perjanjian yang ideal bagi pihak-pihak yang terkait. Di masyarakat masih banyak permasalahan dalam pembatalan akta perjanjian pengikatan jual beli tanah dan proses penyelesaiannya. Permasalahan tersebut mungkin muncul karena adanya perbedaan penafsiran, kurang kesepahaman antara para pihak yang satu dan yang lain, serta perselisihan karena salah satu pihak memang tidak dapat memenuhinya. Apabila permasalahan dalam perjanjian belum dapat diselesaikan dengan cara musyawarah, litigasi dan alternatif penyelesaian sengketa maka penyelesaian permasalahan dalam perjanjian dapat dilakukan pembatalan perjanjian berdasarkan undang-undang yang berlaku.
