Summary:This paper attempts to state, based on theoretical foundations, some of the problems presented by the Justice and Peace Law from two perspectives: the first one related to the text itself, and the second to the peace process praxis. By the same token, it outlines the tension of these referents with some sections of the Statute of the International Criminal Court, namely: the preamble, the principle of complementarity, and the interests of justice.
