El pronunciamiento del Tribunal de Justicia a la luz de las recientes iniciativas legislativas europeas a propósito de las obras descatalogadas. | (Abstract) The Court of Justice has recently analysed the compatibility of the French regulation about certain uses of out-of-commerce works with the Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society (judgment of 16 November 2016, case C-301/15, Soulier and Doke). The absence of specific provisions in the Directive regarding out-of-commerce works has led to a variety of regulations in this regard in the different Member States. A unitary solution is needed in order to avoid disparity of regulations, as it has been the case concerning orphan works. The proposal for a Directive of the European Parliament and of the Council on copyright in the Digital Single Market of 14 september 2016 deals with this subject in some provisions but a more precise regulation is recommended. |
