| Summary: | The Constellation of Woman Power in Judicial Review of Marriage Law No. 1 of 1974: Constructional Analysis of Mohammed Arkoun’s Islamic Thought. This paper analyzes about Indonesian Ulama Council explanation in testing a judicial review of UUP No. 1 of 1974 to the Constitutional Court to revise the minimum age of women marriage from 16 years to 18 years. The formulation of the problem in this research is how to deconstruct MUI information in the testing of UUP No. 1 of 1974. The study in this paper is a literature review using the Islamic epistemology approach of deconstruction analysis Mohammed Arkoun. The study finds that the reason for the MUI related to the concept of bâligh which is the view of fiqh of Imam Shâfi‘i has two intentions. First, the unspeakable desire by the institution of the MUI that men want to be superior over women. Second, while the stated wish is that MUI brings religious argument in this case uses Imam Shâfi‘i’s fiqh to strengthen the view in the explanation of material testing in the Constitutional Court. |
