In particular, in Chavez-Vilchez case (judgment of 10 May 2017, case C-133/15) - in which the majority of the applicants had not exercised their right to free movement - the Court of Justice has specified, in accordance with the notion of the effectiveness of Union citizenship, the conditions under which Art. 20 TFEU could apply when it is not demonstrated the lack of capacity of the other parent - EU citizen - to assume the responsibility of the care of the child. |
