description The purpose of this essay is to establish the main guidelines of a research which, contrary to the general criteria, considers the “Constitution of Cadiz” not as an authentic Constitution according to the modern sense, but as some sort of recap of the legal life from the Ancien Régime, a historical Constitution which gathered and arranged the Fundamental Laws with some slight additions. Constituent power, nation or national sovereignty are some of the concepts subject to analysis in order to support the previous assertion.
