description | The author of this paper analyses organization and jurisdiction of courts in Bosnia and Herzegovina, starting from the Court of Bosnia and Herzegovina, municipal, cantonal, and the Supreme Court of the Federation of Bosnia and Herzegovina, general (basic, district and Supreme Court) and special courts (district commercial courts and the Higher Commercial Court) of the Republic of Srpska and basic and appellate court of Brcko District of Bosnia and Herzegovina. Making a comparison between these courts we can conclude that there are similarities between the courts of general jurisdiction in the entities and the district. As a special feature we can identify the Court of Bosnia and Herzegovina which has no appellate court nor the constitutional base for its establishment and courts of special jurisdiction in the Republic of Srpska, which do not exist in other parts of the country, but their presence is evident in the region. There is no Supreme Court of Bosnia and Herzegovina. In addition, the specificity of Bosnia and Herzegovina is its Constitutional Court, which has appellate jurisdiction that should belong to the ordinary courts and the courts of Brcko District, which examined the statutarity and legality, the functions that belong to the constitutional judiciary. |
