| description | El presente artículo refleja la evolución histórica del tratamiento legal que se le ha dado a la mujer y sus derechos en el proceso de creación y desarrollo del vigente ordenamiento jurídico cubano, así como una exposición cronológica del comportamiento del enfoque de género en dichas disposiciones normativas desde el período colonial hasta la actualidad. Se analiza además, su manifestación en el Derecho Penal actual y a partir de ello, se compara jurídicamente el delito de violación en países como Venezuela, Argentina, Bolivia y España. Dentro de los resultados se obtuvo que son significativos los avances en virtud del principio de igualdad que ofrece la ley cubana, aunque presenta regulaciones que responden a un sistema patriarcal desfavorable para la mujer, cuando debería existir equidad de género para ambos sexos.
This article reflects the historical evolution of the legal treatment that has been given to women and their rights in the process of creation and development of the current Cuban legal system, as well as a chronological exposition of the behaviour of the gender approach in these normative dispositions from the colonial period until the present time. It is also analysed, its manifestation in the current Criminal Law and from this, legally compares the crime of rape in countries such as Venezuela, Argentina, Bolivia and Spain. The results show that the progress made under the principle of equality offered by Cuban law is significant, although it presents regulations that respond to a patriarchal system that is unfavourable for women, when there should be gender equity to both sexes. |
