Summary:This article analyzes one of the most traditional issues in the criminal jurisdiction, it is the applicability of the modifier circumstances of the criminal responsibility for the existence of any anomaly or mental disorder. Specifically, the key hypothesis is established on the possible exemption of criminal liability (Article 20.1 Criminal Law) in those subjects with an Attention Deficit Disorder and Hyperactivity Disorder (ADHD), for which it will be revised and analyzed - both legislative and jurisprudential-, the psychopathologies that have been commonly accepted by criminal law doctrine. This study leads to a critical view about what it is known as "permanent psychopathologies” by the spanish legislator in the implicit literal redaction of the Criminal Code. This question is going to be discussed and answered from an interdisciplinary understanding of psychopathologies.
