| description | <p>Acest articol vine în calitate de replică la opiniile adepţilor acauzalităţii inacţiunii. Prin urmare, este combătută afir-<br />maţia celor din urmă, legată de suficienţa neîndeplinirii obligaţiunii obiective de a acţiona pentru fundamentarea răspun-<br />derii penale pentru inacţiune. Argumentarea acauzalităţii inacţiunii nu se poate, în genere, baza pe trimiterile la temeiul <br />răspunderii penale. Este demonstrat faptul că legătura cauzală este un semn obligatoriu al laturii obiective a oricărei <br />componenţe materiale de infracţiune. <br />Negarea caracterului cauzator al inacţiunii de către aceiaşi adepţi ai acauzalităţii inacţiunii este uşor combătută prin <br />teoria deosebirii categoriei cauzalităţii, a construcţiei teoretice a legăturii cauzale şi a mecanismului cauzării empirice. <br />De menţionat că terminologia utilizată în prezentul articol este aplicată pentru prima dată în domeniul determinismu-<br />lui cauzalităţii (cum ar fi noţiunile generale ale teoriilor şi termenii acestora). În aceeaşi ordine de idei, în cadrul studiu-<br />lui de faţă se face o abatere de la regulă, şi anume: sunt delimitate, în calitate de obiecte de sine stătătoare de studiu, <br />categoria cauzalităţii şi diferitele noţiuni propuse legăturii cauzale (precum: construcţia teoretică şi mecanismul cauzării <br />empirice).</p><p><strong>STRENGTHENING THE CAUSATIVE NATURE OF THE INACTION THROUGH THE APPLICATION OF THE THEORY WITH REGARD TO THE CAUSALITY CATEGORY DISTINCTION, THE THEORETICAL CONSTRUCTION OF THE CAUSAL LINK AND THE MECHANISM OF EMPIRICAL CAUSATION</strong></p><p>This article comes as a response to the opinions of the followers of acausality of inaction. It is therefore refuted their <br />allegation that the failure to fulfill the objective obligation to act is sufficient to enable the penal liability for inaction. <br />Pleading for the acausality of inaction can’t be done, in general, whilst also making references to the basis of penal liability. <br />It is shown that the causal link is an obligatory sign of the objective side of any material component of the offence. <br />The denial of the causative nature of inaction by the same followers of acausality of inaction is easily countered <br />through the theory with regard to the causality category distinction, the theoretical construction of the causal link and <br />the mechanism of empirical causation. <br />It is very important to note that this article introduces the terminology used in the study applied for the first time in <br />the field of determinism of causality (the general notions of the theories and their concepts are applied for the first time). <br />In the same time, within the study is made a deviation from the rule and as a result are delineated as independent objects <br />of study, the causality category and the different notions advanced to the causal link (such as: the theoretical construction <br />and the mechanism of empirical causation).</p> |
