It is based on an analysis of decisions questioning the danger or safety of phytopharmaceuticals before administrative and judicial courts (civil, criminal, social chambers). First, it is troubling to note the general vagueness with which scientific knowledge is identified in judgments and case studies and also the variety of ways the judge used them. The article presents secondly, under what circumstances the judge appealed to or leaned on (or not) on these sources in light of scientific uncertainty. It will, in effect, have to decide based on the elements of fact and law and in light of scientific studies, the findings of the court expert opinion or conflicting public agencies. This study invites us to reflect, especially through the example of the harm caused to bees, on the correlations or absence of correlations between scientific and legal uncertainties. |
