description | The purpose of this paper is to characterize a secret invention and to evaluate and analyze this legal institution in the context of security protection. A secret invention is an exception to the principle of disclosure of inventions, commonly used in both Polish and international patent law. This special solution is of great importance in the field of national defense and security, enabling control over the effects of research and development in the area of broadly understood security. The main research methods that were used in this work are the method of analysis, the legal-empirical method and the method of synthesis. System analysis allowed establishing patent protection principles and distinguishing the principle of public transparency in this area. A critical analysis based on the analysis of the texts of legal acts from the studied area allowed determining the essence of a secret invention, understand and interpret legal procedures related to the classification of the invention. On the other hand, legal and empirical studies were used to clarify doubts in the practical application of provisions of statutory law. In order to make the necessary generalizations and present the final conclusions, the synthesis method was applied. |
