processing of the request ex. Recht van Opstal No. 1090 and the obstacles during
processed of the land tenure ex. Recht van Opstal.
This research descriptive and using juridical normative method. Legal research
conducted through literature reviews to obtain secondary data and followed with
fields studies to collect primary data. Responden are chosen using purposive
sampling techniques and the data were collected through documentary studies and
interviews. The research site at Kelurahan Bausasran, Kecamatan Danurejan, Kota
Yogyakarta. Hence, technique of data analysis used is qualitative data analysis.
The citizens request on right of Structure and Building Purpose (HGB) at
Kelurahan Bausasran is implementation of the first time registration activities on
giving. According to Clause V Conversion of the Basic Agrarian Law (UUPA) and
then according to the provition of Goverment Arrange No. 24 Year 1997 and the
National Land Agency Regulation No. 9 Year 1999. The citizens request a decree and
certificate on the right of Structure and Building Purpose (HGB) to the National Land
Agency but the heir want the citizens for pay a compensation. The obstacle is before
the citizens requested of the land title must be pay a compensation. |
