care of the children before they grown up to be mature. This research is purposed
to know: problems of children taking care according to Islamic law and Positive
law, appointing of taking care right upon the children at the religion court in
padang and bamers that faced by the judges at the Regilion Court in Padang. To
devide or to ascertain the taking care right of the children.
This research is combined both of yuridic normative research and juridical
sosilogical research. After doing the preface step, the operational step is done by
collect sekunder data (through library research) and primer data (through field
research). Data collected by library study and interview, when the data is enough
to do editing step, then it will be analyzed according to kualitatif.
From the research, known that (1) there is the similiraty and the difference
between Islamic law and positive law about the taking care of the children. If the
Islamic law prefers to give the priority for mother or mother relatives, the positive
law is giving the same opportunity to both side. (2) In Religion Caourt in Padang,
the judges generally give decision of the taking care right to mother side or female
relatives from mother�s line. Sometimes the right is given at the same time with
separation decision. Sometimes through the decision of hadhanah case or
hadhanah decision based of the requesr. (3) In law consideration, the judges prefer
to the appointment in Islamic law and verbal agreement that is made by both side.
The barriers that are faced by the judge are the difficullity in value the witnesses
testify. Estimate the readiness of caretaker candidate, oppress to the judges from
the side of claimer and being claimed and face the execution that is difficult to do. |
