rights of migrant workers and their protection lies behind the writing of this thesis.
The debate on the issue arising since early 2005 when this issue is circulating in
the community. It is interesting assessed particularly on the legal aspects of legal
protection for Indonesian migrant workers who work abroad. Therefore, a study
conducted in this thesis also includes the reasons for the importance of ratifying
the jurisdiction clause and the consequences that arise when Indonesia ratifies
such conventions. The purpose of this study include, among others, to contribute
their thoughts on the need for Indonesia to ratify the international conventions as
well as clauses that must be met if ratified Indonesia. In order to obtain the data to
be able to answer the problem in this study, the authors conduct library research
and field data is then analyzed by using qualitative analysis. The weak point of
protection of the TKI/ BMI does not only occur at the time of placement but also
during pre-placement. In addition to providing legal protection for migrant
workers and their families to ratify these conventions can also provide Indonesia's
bargaining position higher in the case of international migrants in the world, there
are some regulations in Indonesia related to the legal protection of migrant
workers who have adapted to the conventions. like anti-discrimination clause,
family protection clause TKI / BMI (the principle of protection of the family as a
unit), freedom of association clause, the prevention of acts of abuse to the TKI /
BMI, and the arrangement of the TKI / BMI undocumented. |
