| description | Former land of custom was registered sporadically and systematically for the first time. It was meant to protect land owners and guarantee the law security. In fact, the land owners were hindered by several obstacles during the process of regis-tration. The Government Act number 24/1997 of Land Registration offered two choices to solve the problem. The registration could be executed sporadically or sys-tematically. It is recommended that the land owners have legal proofs of the owner-ship. The purpose of this research is to know the execution of registering the former land of custom for the first time in Jetis District of Bantul Regency and to find out the emerging factors that have hindered the execution.
The research used juridical and empirical approach methods. All the prima-ry data were collected from interviews with the interviewees and through questioners from the respondents. The secondary data were gained through literature study , i.e. documentary study and published references. The primary and secondary data were then arranged systematically and analysed to answer the problems found in the re-search.
From the research it was found out that the registration of the former land of custom in Jetis District of Bantul Regency could be proposed by the land owners themselves or by their representatives to the state land office. Meanwhile the land owners might choose whether they wanted to register the land in a common way, i.e. sporadically dan systematically or through a special program called PRONA ( Na-tional Operation Project of Agriculture ). The research finding showed that the exe-cution of registering the former land of custom in Jetis District of Bantul Regency was not satisfactory. There were many factors hindering the execution. The sociali-zation of the importance of land registration to gain certificates and to guarantee the legal ownership of the land needs to be done intensively and extensively. It could be concluded from the research in Jetis District of Bantul Province that the community have to be alerted to awaken their awareness of the importance of registering their former land of custom. Intensive and extensive socialization needs to be carried out so that the former land of custom could be legally certified and the owners will feel secure. In the end, the Government through its Act number 24/1997 of Land Regis-tration could reach the goal of legal order of land administration. |
