Research on �Execution Fiduciary Guarantee Bank BPR Sleman according to
Act No. 42 of 1999 concerning the Fiduciary Guarantee� is the Juridical nature of the
Empirical research, namely research deepen application of positive legislation in
practice. As the juridical research, then research is empirical based on research
libraries covering legal materials as well as field research (empirical) to obtain the
data. The sample executed with the technique of non random sampling. The kind of
the sample be used in this research is purposive of sampling. The results of this
research are expected to be able to give you an idea thoroughly and systematically
regarding legal principles, methods, and method-law doctrine as well as the laws and
regulations relating to the exercise of Fiduciary Guarantee execution on BPR. The
Bank is also expected to be the town of Sleman.
To the execution fiduciary guarantee caused because debitor injury
appointments in BPR. bank Sleman which are in accordance with act no. 42 / 1999 on
fiduciary security namely sales under hand object fiduciary guarantee with agreement
between debitor with creditor. Originally the debtor the opportunity to sell their own
given object, if the fiduciary guarantee the debtor cannot afford to sell themselves,
then with an agreement with the Bank is doing the BPR Sleman guarantee such
fiduciary sales object. Proceeds of the sale directly be submitted to the bank for the
repayment of debt debitor, if of the proceeds still not enough debitor must remain pay
off has put but if it sold the result was enough then the advantage be returned to
debitor. Constraints faced BPR. Bank Sleman in the execution is not cooperative
debitor fiduciary security guarantees would be drawn. |
