description | The research aims to observe juridical construction of agreement with the
BOT system in renovation of the Antasari Central Market agreed between the
Governent of Banjarmasin City with PT. Giri Jaladhi Wana, and know the
substance of the BOT agreement in order to provide law protection of the parties.
This research is juridical normative about enforcement or application the
provisions of normative law in real behavior at any legal events occured in the
community, based on the research literature and to complement data obtained
from the field research. This research presented in a descriptive report since from
the research results are expected can provide comprehensive and systematic
overview on the law principles, the rules of law, doctrine and legislation regarding
the law construction law of BOT pattern agreement made between the
Government of Banjarmasin City with PT. Giri Jaladhi Wana, has analytical
characteristic since from the research results will be conducted analysis in
various aspects of law to address the research problem.
The results showed that (1) the Law construction of joint agreement of BOT
system in redevelopment the Antasari Central Markets between the Government
of Banjarmasin City with PT.Giri Jaladhi Wana. The agreement which the base
refers to the freedom principle of contract can be seen in selection the form of
contract, with whom doing contract, agreement content, and the choice of
common law position and remain in relation to the agreement and all legal
consequences. Although it can be said not complete when compared to the
legislation in force, substantially this agreement had in compliance with the
freedom principle of contract especially the validity of agreement as regulated in
Article 1320 of Civil Code. (2) The agreement not much governed concerning to
the third party, whereas the third party both the merchants and other interested
parties opon the shop or stall is should be governed as well the rights and
obligations adequately. The third party is given only law protection by giving 25-
years lease right to purchaser or lessee of PT Giri Jaladhi Wana. It is as included
in Article 15 paragraph 1 letter d. |
