| Summary: | This study aims to: (1) to determine the implementation of tribal societies
Betawi marriage under adat law in the special jakarta particularly Condet village, (2)
to determine the implementation of inheritance under adat law Betawi tribe in the
special jakarta particularly Condet village, (3) to determine the constraints occurred in
the implementation of marriage and inheritance Betawi ethnic communities under
adat law and to know the efforts made to overcome these obstacles.
This thesis research is a juridical sociological research. The preparation is
based on field research to obtain primary data and literature research to obtain
secondary data, with each data collection technique through interviews and literature
review. Respondent 9 (nine) members selected from the Betawi people in the region
Condet, District Kramat Jati, Jakarta Timu.Seluruh the data was analyzed with
qualitative methods.
The results of this study are: (1) marriage according to traditional Betawi not
only bring civil legal consequences of the relationship, such as the obligations and
rights of husband and wife, child, joint property, but also about the relationships of
family customs, kinship, and the ritual also involves traditional and religious
ceremonies, (2) the public interest Betawi is parental social groups, so that there is no
difference between the right and the position of men and women. Therefore in terms
of inheritance there is no difference between the heirs of men and women. All have
the same position in the heir, (3) there is no choice in the implementation of marriage
and inheritance Betawi ethnic Betawi people are different from those in the teachings
of Islam.
