Summary: | This study aims to determine: (1) of the role of judges in the judicial
settlement of civil disputes through mediation agency at the Central Jakarta District
Court, and (3) Factors impeding or inhibiting the implementation of the role of judges
in the judicial settlement of civil disputes through mediation institutions at the Central
Jakarta District Court.
This research is an empirical legal research using the sociological approach of
juridical normative research support. Type of data in this study are primary data and
secondary data. Primary data from field research, while the secondary data obtained
from literature study. Techniques of data retrieval is done by way of interviews with
resource persons and respondents. Further research data analyzed by descriptive
qualitative methods.
The results of this study shows: (1) the implementation of the role of judges in
the judicial settlement of civil disputes through mediation agency covers several areas
namely: (a) suggest or urge the parties to the path of mediation, (b) to advise in
selection of a mediator provided, (c) monitoring of the mediation process that is seen
from time delivery resume case, and (d) peace agreement that has been produced by
the parties to the dispute with a mediator
