Summary: | Land is an important resource for development. Land supply for public
purpose development known as compulsory acquisition of land. Compulsory
acquisition of land for Putih River diversion channel occurs when there is a
transition regulation, as an emergency post disaster project, and the deal price
occurs fast. The study objectives are to explain the process determining
compensation for compulsory acquisition of land for the Putih River diversion
channel and to identify the factors that make the deal happened. The research area
is Gulon and Jumoyo Villages, Salam District, Magelang Regency. The research
used primary and secondary data from the Second Section of Putih River
diversion channel compulsory acquisition of land. It applied inductive method
with case study approach.
Compensation determination process held by negotiating the land price
between BBWSSO and the landowners. BBWSSO offers the lands compensation
based on the valuation by the appraisers team. The landowners determine lands
price based on compensation from Section I (the earlier project), lands
productivity, accessibility, lack of lands, and opportunity cost if they have to buy
lands away from the existing land. Factors that support the deal price are post
disaster conditions makes the landowners need safety and cash soon, the free
deliberation, and good communication between the government and landowners.
It make them give their land for public purpose voluntary for communities safety.
The deal price is a form of conflict resolution between BBWSSO and the
landowners, compromising, and obliging among the landowners.
In the process of determining compensation, the deliberation can not held
through a normal procedure. The deliberation that supports the deal price, base on
transparency and freedom to argue, dependent on the local culture. To support the
transparency, the land acquisition committee (P2T) should inform everything
related to compulsory acquisition of land include the regulations. To accelerate
the compulsory acquisition of land process, improvements in land information
system that being able to identify the land parcels is needed. It requires further
research about land valuation for compulsory acquisition of land as a comparison
the land valuation by the appraisers team.
