| description | This study discussed about the existention of the values of Pancasila in the
constitutional review in Mahkamah Konstitusi. This study was aimed to find out
the Pancasila potition�s in constitutional review, and to find out the
implementation of that values in contitutional review by Mahkamah Konstitusi.
This study was a legal research or rather than called as normatve legal
research using three types of approaches, e.q. statute approach, case approach,
and conceptional approach, and as descriptive research.
The potition of values of Pancasila in constitutional review is very
important and determine because the values of Pancasila as fondation and
ideology of state is integral part of UUD NRI Tahun 1945. The values of
Pancasila is one of the acid test in constitutional review. Implementation and
application of Pancasila was occured by decisions of Mahkamah Konstitusi.
During establishment of Mahkamah Konstitusi (2003) until 2012, decisions of
Mahkamah Konstitusi maketh of Pancasila as an acid test in constitutional
review. Until now, the valeues of Pancasila never been used as acid test in
petition of constitutional review, but in decising a petition of constitutional review
Mahkamah Konstitusi always implay the values of Pancasila. |
