Summary: | This research was intended to study further process of credit card issuing in PT
Bank Mandiri (Persero) Tbk and efforts done for settling problem of customer not paying
monthly credit card billing that cause bad debt.
This is literary study to get secondary data completed with empirical study to get
primary data. Data collected was analyzed juridical normatively.
Results of the research indicated that in process of credit card issuance there are
some regulations that is contrary with Civil Law Code related to card freezing or denial of
authority application without permit based on Article 1338 Civil Law Code and Article
1320 point (1) Civil Law Code relating to terms and conditions of Mandiri credit card that
stipulates that they any time subject to change based on Bank consideration and due to
change in regulation underlying it. Obstacles in bad debt collection with non litigation
procedure is rescheduling, reconditioning, restructuring and in customer aspect is
transferring charge to third party, negotiation and litigation procedure.
