| description | This study aims to view the process and effectiveness of mediation conducted by
provincial government of NTT mediation in boundary conflicts. Cases referred to boundary
conflict between the government of Belu and Timor Tengah Selatan (TTS) Regency. It has
been occurred for long time before those areas were formed in the governmental districts.
Settlement efforts have been made but that is failed and not optimal yet. Boundary conflict is
impacting on horizontal conflicts between communities as well as have an impact on the
implementation of the tasks of government to serve the communities.
On the basis of these observations, the research done by selecting the type of
descriptive-analytical study. The horizontal conflict in dispute area bring negative effects in the
development of the nation and state. The findings on the ground that the border conflict
between TTS and Belu regency caused by dualism references point boundary determination
are conflicting and even contradictory. The conflict is further complicated because it is
influenced by legal factors, economic, and cultural history. Legal factors relating to the process
of forming laws. There are hasty, and lack of socialization of Law 69 on 1958 about settlement
regulation of Belu and TTS regency. Economic factors related to the limitations of the land
that is source of life in the region Lotas. In the other hand is related with amount of General
Allocation Fund (Dana Alokasi Umum) to the district that one indicator is the total area. In
addition, the total number of people affected was a local tax. When a region included in
another district, the community which inhabiting the region will become citizens of the district.
This implies a reduction in the tax district. While historical factors also influence because
Lotas territory inhabited by the tribe that is the kingdom of Wesei Wehali (Belu). Naiusu
People living in the area that is administered Lotas included in the TTS.
NTT provincial government has made efforts to mediate a settlement with both sides
through four main activities, namely: 1). Public administration, 2). Meeting Preparation, 3).
Meeting with people of both districts and 4). Meetings with both governments. The result in
terms of the process is quite successful because it was reach and produce some agreements.
However, referring to the purpose of the mediation is not optimal because it is influenced by
two factors: First, the internal factors. Internal factors related to the neutrality and impartiality
of the mediator as well as actors from the two districts involved in the mediation process itself.
Second, external factors. External factors is political and approach to ministry factor. Political
factors related to the interests of electoral districts (constituencies), potential voters and other
political interests. These factors related to service approach with the wishes of the community
to get service faster and near from the center of waiters. |
