| Summary: | The purpose of this research is to find excuses or background for a usage
rights on land is given to the city government Banjarmasin and to know constraint
land agency countries in control of government office who acquires a usage rights
on land banjarmasin displaced in the city.
In research this kind of approach use juridical empirical, namely research
turning point their observations lie in reality or facts existing social and live in a
society as culture people life. Means the sample reference to purposive sampling
namely respondents be samples had in determine beforehand, so that the sample
not based on stratum or random. Research is done through live interview to the
field is by office land agencies, department office health and office licensing city
banjarmasain, against all the data been obtained from research analyzed by
method even a qualitative manner research that yields data descriptive analytical,
manifested by the respondents in writing or spoken and behaviors that reality of
the respondents.
The research found that over land usage rights that are already given to City
Government Offices because of the budget revenue of Banjarmasin abandoned
shopping area, the construction of new offices and has not been any government
regulation of the Space Center. Obstacles faced by the national land Agency in
regulate land usage rights that have been abandoned by the Government agencies
that have been given permission in the town of Banjarmasin is there is no rule of
law against the abandoned lands by the Government agencies, the absence of a
section in the Government agency specifically tasked with controlling and
monitoring the problem and wastelands in a sweeping consent decree over land
usage rights in the certificate does not mention that there is a time limit on the use
of privileges.
