| Summary: | This research was intended to study and analyze settlement done by
creditor over debtor transferring fiduciary collateral object to third party and
settlement done by creditor over unregistered fiduciary collateral object.
This was juridical empirical research that was based on field study and
literary study to complete data. Primary and secondary data was processed
qualitatively and presented descriptively by explaining and describing matters
related to its results.
The research�s result indicated that (1) settlement of fiduciary collateral
object transfer by debtor to third party done by PT Adira Dinamika Multi Finance,
Barabai Branch was conducted according to procedure and rules determined by
the company in which collateral object was drawn and then sold in auction that do
not comply with regulation of auction and not conducted by auction officer. (2)
PT Adira Dinamika Multi Finance, Barabai Branch did not register fiduciary
collateral object to Fiduciary Registration Office so settlement the company can
do is by filing law suit to court and its standing is same as other creditor as
concurrent creditor |
