Summary: | The purpose of this research is to review the Public Notary
professionalism in serving legal consultation to client according to the Law of
Public Notary Profession and Public Notary Code of Conduct at Batam city, and to get clear idea and to analyze the control by the Honorary Board on Public Notary in serving legal consultation according to the Public Notary Code of Conduct at Batam city.
The nature of the research is yuridis empirical which is a form of approach
on the respondent and source person matters, by analyzing the valid legal norms in its relation to the phenomenon of the matter arises during the research. The research was conducted at Batam city. Data source utilized are primer data, by interview method and secondary data, by library research. Data collection was conducted by non random sampling by utilizing purposes sampling, which was collected by paying attention to few criteria according to the objects that meets the purpose of the research. Data gathered was analyzed by qualitative method, by describing and detailing the subject according to the matters related to the result of the research.
Serving legal consultation to client according to the Law of Public Notary
Profession and Public Notary Code of Conduct at Batam city in the practical that happens, a Public Notary did not carry out the duties in serving legal consultation to client and Public Notary was tend to prioritize the potential clients who will make a deed, rather than to those client who are only seeking consultation. Public Notary did not serves consultation as per their knowledge. Controls by Local Honorary Board at Batam city towards the Public Notary who did not serves legal consultation according to the Code of Conduct were hard to trace, as it is involving Public Notary himself and the client. Therefore, the misconduct could only be checked further in case there is any complaint lodged by client. Local Honorary Board would only conduct an investigation based on reports by the client.
