| Summary: | This research is concerning on � Refusal of the Land Registration Based
on Court Decision at the Land Office of Sleman District�. It is aimed to discover
the process of grant or refusal of land registration application based on court
Decision at the Land Office of Sleman District and the legal effects of the refusal
of the land registration application based on Court Decision for the applicants or
the Land Office.
This research is an empirical legal research where the observed object was
legal behavior i.e. the apparatus� behavior of the Land Office in deciding to grant
or refusal the land registration application based on Court Decision. The research
conducted by direct interviews with the land office apparatus, applicants and
sources and supported by secondary data that connected with the research.
From the research obtained result that the grant or refusal process of land
registration application based on court Decision at the Land Office of Sleman
District has been conducted by the land office apparatus pursuant to applicable
mechanism, but in its implementation still requires quite long time due to limited
implementer personnel. The refusal on land registration application based on court
decision that has met the requirements may cause legal effects for the applicants
and disadvantaging their interests. The application refusal that conducted based on
improper reason even pursuant to applicable mechanism may cause legal effects
for the Land Office. Therefore, the Land Office in creating consideration to
refusal registration application must be more careful and thorough in order to not
emerging new issues in the future days, in addition the amount of implementer
personnel at land office must be added to accelerate the process as expected by the
public.
