joint use rights certficate issuance by the BPN to PT. Sweet Indo Lampung in
villages Menggala Tengah e District Menggala Tulang Bawang Regency of
Lampung Province, anda to find out the causes of the occurence of customary law
community conflict in Lingkungan Lingai dan Lingkungan Kibang in villages
Menggala Tengah District Menggala Tulang Bawang Regency of Lampung
Province.
This research is normative empirical research. Normative empirical law is
indentified and conceptualizedas a social institution in the system of real dan
functional patterns of life. Normative in this study, is the approach in terms
legislation and legal norm in accordance with existing problems. While the
empirical approach, is empasized research aimed at obtaining empirical
knowledge live on object. The study was presentedin the form of a
descriptiveanalitial report, where data has been processed then analized
qualitatively.
The result obtained is as follows: 1). Rights ulayat customary law within
society and within kibang lingai. Ulayat right in their own existence and the range
kibang lingai is correct can be seen from a fixed range of activities performed as
usual with farming in Society Land left. 2) the right to use effort Legality PT.
Sweet Indo Lampung is appropriate provisions contained in UUPA and
Government Regulation No. 40 of 1996 Section 7, the right to use effort occurred
since registered by the Lands Office in accordance with the land book of
legislation that happening. 3). Factor due to the cause of the 3 (three) the role of
government that is existence, existence and availability of the pins shift the role of
custom figures that leverage the situation for private interests. |
