| description | This research was intended to identify violation done by foundation
executive on provision in foundation�s article of corporation and to identify
responsibility of executive on the violation.
It used juridical empirical law research completed with juridical normative
law research. Data was obtained by literary study and field study. Sample was
taken using purposive sampling technique. All data obtained was analyzed
qualitatively and written in descriptive form to give objective and actual
description from existing problem.
The result indicated that in practice violation done by executive on
provision in the article of corporation is on implementation of Article 3 on
foundation activities, Article 14 paragraph (3) on reward for executive and Article
35 paragraph (6) on notification of annual report summary. Second, executive is
not responsible for violation they done because control function of patron and
supervisor did not run as due. In juridical sense, violation of executive on Article
3 and Article 35 paragraph (6) of the article of corporation can be asked
responsibility according to Article 35 paragraph (5) Law on Foundation, while
violation against Article 14 paragraph (3) of the article of corporation can be
imposed with criminal sanction according to article 70 of the Foundation Law. |
