| Summary: | 1. Some transfer and registration of land title due to inheritance in adat law society in
Jambi Selatan, Jambi have been done according to Government Regulation number
24/1997 concerning Land registration. However, there is some people in adat law
society that have not registered transfer of land title due to inheritance.
2. Factors causing people in adat law society did not registered transfer of land title due to inheritance is unknowing about importance of land certificate as law certainty
assurance, as sufficient and safe proof, take long time, expensive registration cost, no
urgent needs, fear of employee in agrarian office that take benefit from people
unknowns to get addition fee over the registration
3. Attempts done by Jambi Agrarian Office in dealing with obstacles in implementation
of transfer and registration land title right due to inheritance is by conducting
dissemination on the law to people, improve human resource in the office, do the
Agrarian National Project (PRONA) and people service for land certificate
(LARASITA). Objective of the research was to identify and analyze implementation of transfer and registration of land title due to inheritance by people in adat society in Jambi Selatan, factors causing the people not registering land title due to inheritance and attempts by Agrarian office to deal with obstacle in transfer and registration of right over land due to inheritance. The research used juridical empirical method emphasizing field study to get primary data directly from informant and/or respondents that truly know the matter. All data gathered was analyzed qualitatively. Based on the research result, the conclusions are drawn as follow
