process can be done when the devisor was still alive until after the devisor dies.
Along with the events and circumstances of life after another, then the inheritance
process conducted subject to change and can not rule out the possibility of a
conflict between the heirs, it is necessary to attempt settlement.
This research was conducted was conducted through two approaches, namely
normative and empirical approaches. Method of sampling in this research is to use
nonprobality sampling techniques. Type of sample used is judgmental or
purposive sampling. Primary data and secondary data were analyzed qualitatively.
The results of research showed that the child of devisor property and
community property devisor origin, adopted children are entitled only heir of the
estate with his adoptive parents, step children is not an heir and illegitimate child
only heir from his biological mother and his biological mother's relatives. Boys
got a double share of the inheritance girls section when the devisor is alive,
because of local customs regulations influenced by Islamic law. Partly of Using
society applying segendong sepikul distribution pattern and partly to divide the
inheritance equally between boys with the girls after the devisor dies, in the
beginning when inheritance is done with the segendong sepikul formula. The
changes are influenced by the needs, interests and views that men and women
have equal rights. The role of parents in providing understanding to the heirs can
not be ignored in order to avoid disputes. Dispute resolution efforts carried out in
three phases, namely musyawah family, meetings with village officials, the courts.
Rights will be better protected heirs if there is written evidence. |
