Summary: | This study aims to analyze the estimated compensation value to the process of
land acquisition for public purposes by using legislation that recently, namely
Undang-Undang No. 2 tahun 2012, Peraturan Presiden No. 71 tahun 2012 and
Peraturan Kepala BPN RI No. 5 tahun 2012. Hopefully with this rule provision of land
for public purposes to be more fluent.
The results showed that compensation includes compensation of physical and
non-physical. Physical compensation consists of land, space above and below the
ground, buildings, plants, and objects relating to land, being non-physical damages are
damages that may be assessed which consist of transaction costs, business interruption
losses and reimbursement against losses waiver.
The conclusion of this research is the value of compensation for land is the
sum of the market value of the land plus the replacement of non-physical (premium)
the amount of at least 1, 15 percent and as high as 1.71 percent of the market value of
the land. Compensation for the value of buildings and objects relating to the land is the
replacement cost of new buildings or objects. Change the value of crop losses is in
accordance with the local regulations or market price of the crop in question.
Compensation value space above ground and below ground does not exist because
there is no use of the space and the basement in the area.
