Summary:This study aims to determine the impact and Legal Protection Circular Ministry of Manpower and Transmigration No. B31/PHIJSK/2012 in the implementation of Security Labour about the rights and obligations of the each parties . This research is normative and empirical legal research , and is said to normative as reviewing secondary data and analyze the data with reference to legal norms as outlined in the legislation , including the principle of law in the systematics of law . Empirical studies have seen the rule of law in the field , results are presented in descriptive analysis which describes the issues discussed and the answer . The results of this study are : First, the impact of Circular Ministry of Manpower and Transmigration No. B31/PHIJSK/I/2012 in implementing outsourcing outsourcing does not negate itself because so far what is stipulated in the Decision and Ministerial Circular Letter has been enacted by The Article of Law No. 13 Year 2003 about Labour . Only provisions regarding the obligation hiring outsourced workers as permanent employees unless there is a clause Transfer of Undertaking Protection of Employment or Tupe who later became obligations of the employer user ( user ) and outsourcing companies to fulfill the outsourcing agreement . Second , the legal protection for workers security guards ( guard ) are placed in the PT . Krakatau Bandar Samudera concerning the protection of wages and welfare is the responsibility of PT . Cipta Citra Pratama . Protection obtained by the Security Unit labor ( guard ) and have to be in accordance with the provisions set forth in Article 62 , paragraph 66 ( 2 ) c, subsection 78 ( 2 ) , subsection 79 ( 2 ) c, subsection 86 ( 1 ) letters a , subsection 90 ( 1 ) , subsection 99 ( 1 ) of Act 13 of 2003 on Labour and its implementing regulations as well as by virtue of Circular Minister of Manpower and Transmigration No. B31/PHIJSK/I/2012 in PT . Krakatau Bandar Samudera that in order to create harmony and protection works in Indonesia.
