Summary: | Research entitled The Legal Relationship Pattern in Traditional Health
Careis the empirical juridical research. The data from libraries research in the
form of secondary data sourced from primary legal materials, secondary legal
materials, tertiary legal materials and field research to obtain primary data about
the traditional acupuncture treatment. The purpose of the research is to examine
the legal relationship form and review the material substance which is regulated in
the legislation which related with legal relationship in the traditional health care of
acupuncture treatment. In collecting secondary data of this study, using
documentation method of document study instrument. Collecting primary data
using unstructured interview with interview guidelines instrument and analyzed
by qualitative deductive. Location research was in the area of the city.
The results showed that the relation of acupuncturists as traditional health
care with patients is therapeutic relation which is in law was categorized as an
alliance which came from treaty. From legal aspects of the relationship that occurs
can be described as therapeutic treaty or transaction, and the object is a form of
healing and health care which included fulfillment of rights and obligations
between one party to another, and the form is engagementeffortwhose
achievements (inspanningverbintenis). In this relation there are rights and
obligations which are reciprocal, acupuncturist�s rights as patient obligations,
patient's rights as acupuncturists obligations. Thus, the parties should be able to
understand each roles, and knowing the legal result which caused by the
therapeutic treaty.
Conclusion the relation of acupuncturists as traditional health is the relation
is therapeutic, which form is engagementeffortwhose achievements
(inspanningverbintenis). The relation characteristic is the existence of treaty
(consensual agreement), and the existence of trust (fiduciary), so the contract
relationship based on mutual trust to trust each other. Based on this thing, then
recommended that acupuncturists as one of traditional medical care should be
careful in acting especially regarding traditional health care towards the patient as
acupuncture treatment receiver, with applying competency standards of
acupuncture and acts based on ethic code of acupuncturists.
