| Summary: | This research is aimed at identifying the position and responsibility of the
parties and the settlement of dispute regarding the granting of power of attorney in
the implementation of Workshop and Ice Factory Construction Project.
This research employed juridical empirical approach. The collected data in
this research included secondary data and primary data. The secondary data were
obtained from library research, while the primary data were obtained directly from
the parties in the field through interview. The data were analyzed qualitatively and
presented descriptively.
The research result indicates that the position of the parties in the
agreement of granting the power of attorney in the implementation of workshop
and ice factory construction project in Banjar Regency is the director of the CV.
Asya is the grantor of the power of attorney and Mr. Bahrul is the grantee of the
power of attorney. The grantee acts for and on behalf of the grantor to carry out
the duty and power stipulated in the deed of granting power of attorney deed. The
agreement gives birth to the bond between the parties which result in rights and
obligation between both parties. Any arising dispute should be settled amicably in
accordance with the existing regulation in the construction working contract in
order to create good relationship between the parties. |
