| description | The purpose of this research is to understand the implementation of auction
execution of prosecutors looting matters that may result in auction in KPKNL
(State Assets and Auction Service Office) and to understand the obstacles in the
implementation that is done by prosecutors to overcome auction execution in
Banjarmasin State Assets and Auction Service Office
This research used juridical empirical approachment, the research that focus
on reality or facts existing among the society, which is aimed to understand the
extent of operation of law in society. Researcher used empirical law research, that
is a legal research that is done by observing primary data. Researcher went into
the field to examine all things related to the problem of research and this study
also used library research.
The results of the research were, first, that the implementation of auction
execution of prosecutors looting matters in Banjarmasin State Assets and Auction
Service Office refers to the applicable auction basic law which are Vendu
Reglement and the applicable auction implementation regulation guideline. The
license was obtained from the chief of looting matters settlement authorized
prosecutor, the license decision of matters auction is performed by KPKNL,
there�s a settlement by selling through KPKNL, transaction of matters auction is
done after court decisions. Second, the obstacles in impelementation of auction
execution of prosecutors looting matters. Procedures of auction execution itself is
too much complicated that are not effective and efficient, lead to decline the
auction price of the looting matters and doesn�t accomplish the specified
minimum price. The other obstacling thing is the limitation of deposit time by
banks, the money from the auction late to be deposited to state treasury. |
