Relationship between lending and borrowing money will cause rights and obligations between the parties there in. Sometimes its financialcondition becomes bad so that it stop paying, that is a condition in which theowners of the company can not pay their debt in time. Debtors or Creditors whohave faced the problem may finish it by bankruptcy, because bankruptcy is one oflegal ways to finish debt problem quickly, openly and effectively.
The researched problems are pay off debt from debitors to creditors by ancrupty and the duties, powers and responsibilities of the curator and also obstacles in finishing in the implementation of the settlement.
The reseach was conduted with using normative judicial method.
The results showed that in the implementation of the bankruptcy estate settlement by curator, and the authorities, duties and responsibilities of curator and also the obstacles faced in the process of bankruptcy.
This research concludes that the implementation of settlement of the bankruptcy is conducted by curator under supervision of suervisor judge, as well as the curator should be held personally liable in case of errors / omissions that cause harm to the bankruptcy estate |
