Summary: | The purpose of this thesis is to identify the process of subjective active novation of house ownership credit in Pan Indonesia Bank Limited, Tbk Makassar Ratulangi Main Branch, and to know the role of notary public in the implementation subjective active novation of house ownership credit of this bank.
This research uses empirical juridical approach method which is based on field research preceded library research for obtaining secondary data. The process and data analysis is carried out by using a qualitative method. Meanwhile the primary data that are taken from respondents and informants through interviewing process are rechecked , and classified for achieving the required research data.
The research shows that (1) the subjective active novation of house ownership process in this bank is implemented as follows: (a) The debtors come to the bank and propose a credit transfer of his/her house, then the bank staff will explain the requirements which must be completed, (b) and after all the documents have been completed, the bank staff will examined the bundle and guarantee based on juridical and economical requirements, (c) After all juridical and economical requirements are agreed, both debtors and banks sign the notary documents in the front of notary public, (d) After the document giving a sign, the bank will pay the credit to the former debtor�s bank, and to change the guarantee right data of the credit guarantee object in land affairs office
