finance agreement deed making in BPR Syariah Bangun Drajat Warga
Yogyakarta.
The method used for this research was empirical and normative juridical,
whereas this study was essentially descriptive. Empirical juridical was by
collecting primary data, from musharakah agreement deeds and interviews with
bank, notaries and clients, also through the normative method, which examined
secondary data from the library and through the study of regulations and other
legal materials that were relevant to this study.
The results can be stated that 1) The Notary�s role as the maker of notary
deed on financing agreement or loan agreement was to comply with the rule of
making deeds. Agreement deed is a perfect evidence and have the executorial
power for in accordance with the rules specified in the Law On Notary. 2)
Musyarakah finance agreement deed was made in the authentic deed so having a
strong legal power. While the financing problem was not on the responsibility of
the notary because the content of the agreement was between the parties
(consensus) and did not contrary with the law and public order |
