Summary: | The research entitled \"Legal protection for Buyer in the Sale and
Purchase of Apartment Units with Booking System (A Case Study of the
Verdict of South Jakarta District Court Number 286/Pdt.G/2012/Jkt-Sel)\"
is aimed at identifying and examining the causes of the problems in the
sale and purchase of apartment with booking system and the form of legal
protection for buyers in the sale and purchase of apartment with booking
system.
This research is a juridical normative research, that is a legal
research on library materials or secondary data. The data used from
primary legal materials included laws and regulations, agreements, and
related verdict. This research was supported with interviews with three
resource persons. The data obtained were analyzed using qualitative
method.
The results of research indicated that problems might occur due to
consumer�s lack of understanding of the procedure of sale and purchase
apartments with booking system. In addition, in the phase of the Sale and
Purchase Commitment Agreement (PPJB) consumers are not given
enough time to read and study the PPJB in advance. Handover delay is
caused by developer in default because the lack of estimated time from the
developer, while the late transfer of the certificate is highly dependent on
the Land Registry Office. The problem regarding land size occurs because
many consumers did not fully understand semigross and net size and just
based on the size number in the PPJB. The form of legal protection for
buyers of apartment units in in the sale and purchase with booking system
is by making PPJB as a form of preventive legal protection. If there are
things in the implementation that are not in accordance with the
agreement, a lawsuit can be filed as a repressive legal protection. In
addition, consumers can also claim their rights in accordance with Article
4 of Act No. 8 of 1999 concerning Consumer Protection.
