Summary: | One of the most favorite football competitions watched by Indonesian people is the
English Premier League. In the 2007-2010 season, the subscription TV operator, known under
the trademark \"Astro\" took over the broadcast Barclays Premier League (BPL). In Indonesia,
over the past few years to 2006, EPL (English Premier League) broadcast and can be enjoyed
either through terrestrial free to air television and subscription television. When Astro has over
BPL broadcasting rights, all TV stations both terrestrial and subscription couldn�t broadcast the
matches of EPL again in Indonesia. Around September 2008, Indovision along with PT. Indosat
Mega Media (IM2) and PT. Indonusa Telemedia (Telkomvision) submitted a report to the
Commission (KPPU) over alleged violations of anti-competitive actions undertaken by Astro.
Indovision�s report to the Commission action is motivated by ESPN Star Sports stop the supply
of EPL broadcast to pay-TV operator/subscribe and terrestrial TV in Indonesia. ESPN Star
Sports as EPL broadcast rights holders for the Indonesian region at all never even notify or
submit an official explanation to the subscription television provider in Indonesia about the
existence of a tender for the rights to broadcast EPL matches for the 2007-2010 match season.
This case has been examined and decided upon by the Commission, but Indovision as the
complainant appealed against the decision of the Commission. Indovision rejected objections
raised by the West Jakarta District Court on the grounds do not meet the legal standing to appeal.
This Legal Research aims to analyze the reasons behind the legal standing of the
reporting entrepreneurs couldn�t raise objections to the decisions. In addressing the problems,
this Research uses library research methodology.
Based on the Research, the result is a reporter entrepreneurs in competition cases is not
entitled to file an objection against the decision of the Commission due to the decision handed
down by the Commission contain matters or legal consequences borne only by the reported
party. Reporting parties here will not get the consequences and impacts associated directly with
the ruling of the Commission.
