description Julian Assange is a founder of a controversial website called WikiLeaks. The main purpose of the website is to give important news for public in its original document alongside with the stories from WikiLeaks�s contributors. However, on 2010 after WikiLeaks leaked 4 United States high classified documents the safety of its founder was in jeopardy. There were possibilities of him being persecuted in United States but in the other hand he had to conduct legal proceeding regarding his sexual charges within Swedish jurisdiction. Due to that condition, Julian Assange requested Ecuadorian government diplomatic asylum in its embassy in London, United Kingdom. Surprisingly, Ecuador granted diplomatic asylum to Julian Assange. This research aims to give analysis concerning the measurement of State before granting diplomatic asylum and the legitimacy of Ecuador�s diplomatic asylum in international law. Hence, the author conducted this research by qualitative explanatory research in order to see the connection between theory and the practice or the implementation of the theory. Based on this research, the reason of human rights protection, security of asylum seeker are the main reasons for State as a standard to grant diplomatic asylum. Yet, political expediency also the influencing factor. Moreover, Julian Assange�s diplomatic asylum cannot be justified under international law since it is a breach of Vienna Convention on Diplomatic Relations and diplomatic asylum is not a practice that is accepted by most of States. The continuation of UN effort to codify diplomatic asylum shall be continued in order to minimize further conflict between States because of diplomatic asylum.
