| description | Industrial design registration is very important for business people. The
objective of this study is to analyze the role of industrial design registration and
the supporting factors and obstacles encountered in order to give legal protection
to craftsmen of the pottery industry in Kasongan, Daerah Istimewa Yogyakarta.
A juridical empirical research was conducted in this study. Data were
obtained through library and field study. The subjects in this study were the Head
of Legal Services and Public of Justice and Human Rights Regional Office in
Yogyakarta and craftsmen of the pottery industry in Kasongan. Fifty craftsmen
were involved in this study. Data were analyzed using descriptive qualitative
method.
The results of this study revealed that: 1) the role of industrial design
registration was to provide protection exclusively for craftsmen that have a
certificate of industrial design. The exclusive right under Article 9 of the Law on
Industrial Designs mentioned that The Right Holder to Industrial Design shall
have the exclusive right to exploit his Industrial Design and to prohibit other who
without his consent make, use, sell, import, export and/or distribute the products
that have been granted the Right to the Industrial Design |
