description The Convention of the Right of the Child shall be implemented within all aspects of the child by Parties States. Consequently, the promulgation of Act 20 of 2003 regarding the National System of Education shall comply with the basic principles of the Convention because Indonesia ratifies the Convention and children are the main stake holder on the assessment of the right of the child to education. This essay tries to examine provisions in the Act whether they comply with the basic principles of the Convention, i.e. non-discrimination (Article 2), best interests of the child (Article 3), right to life, survival and development (Article 6), and participation of child (Article 12) for effective implementation of the Convention applied by the Act. It reveals that certain provisions in the Act do not conform to those basic principles. As a result, it is better that the Act shall be amended by applying those principles
