Summary:ABSTRACTThis research aims at identifying the impeding factors and the strategy of mediator officials in settling industrial relation dispute and dismissal. This is a normative judicial research conducted on 8 mediator officials, 30 businessmen and 30 managing officers of labor unions in companies chosen from a purposive sampling. The resource persons consist of former high-ranking officials of Yogyakarta Regional Office of Manpowers Ministry, high-ranking officials of Yogyakarta P4D (the Secretary of Regional Labour Dispute Settlement) and high-ranking officials of Manpower and Transmigration Service/the former head of Manpower Office of Yogyakarta Municipality, Sleman and Bantul regencies. The instruments for collecting the data are documents, questioners and interviews. The data obtained from the research are analyzed in a qualitative juridical analysis. The research finding shows that there are two factors that impede the mediator official in settling industrial relation dispute and dismissal, i.e., the internal and external factors. The internal factor arises from mediator officials himself resulting from his heavy work load due to the lack of both the quantity and quality of mediator official. The external factor arises from incomplete punishment, lack of the supporting facilities for task implementation, unwillingness of some businessmen to have their conflict settled by mediator official or infered by a third party. The general strategy to overcome these impediments in settling a dispute is to follow the existing rule of law. In addition to it, a specific strategy is applied, i.e., designing work-plan, conducting a discussion among mediator officials, making a personal approach to the disputing parties and forming a team for settling a difficult-to solve conflict.
