Summary:The objective of this research is to find out the law base of the issuing Credit Card as a means of payment between merchant and consumers in Yogyakarta area and also to find out whether the cardholder has already fulfilled the requirement to pay or not if he has just paid using Credit Card. This research is a judicial normative and descriptive research which was carried out by analysing and-reading books as well as scientific paper such as seminars, simposiun or any other scientific works presented in articles and also analysing the available Credit Card regulation which are known as library study. Besides library research, field research is also done through interviews. The interviewees are the Credit Card Managers from 3 different banks, namely, bank Duta, Bank Danamon Indonesia and Bank Internasional Indonesia. Queationaires were also drawn from cardholder and merchant who receives Credit Card Through these two ways (library as well as field research) it is expected that the ibove-mentioned objected can be achieved. The research findings are ah the following : 1. The issuing of Credit Card as a Keens of payment is based on: a. Civil Law Act, particularly Agrement Board. b. Commercial Law Act, particularly on company limited , c. Banking Act no 14 1967, Article 1 item (a) and Article 23 item (9) (Which was already revoked). d. President Decree No. 61 year 1988, on Expense Board e. Monetary Minister Decree No. 1251/ICMK/013//1988. f. Banking Act, no. 7 1992, article 1 item (1) and (2), article 3 and article 6 item (1). 2. Paying responsibility of a cardholder are: a. Seen from the basic agreement, a cardholder has finished paying to the merchant. b. Seen from the Bank-Merchant Agreement, a cardholder has not yet finished paying to the merchant because of the subrogation principle. Key word : a means of payment, merchant, Consumers.
