This research aims to investigate the law that prevails in the division of inheritance as practiced by citizens who are subject to the Civil Code in Banyumas Regency and the settlement procedures in case of dispute over the division of inheritance resulting from a testament that violates the Legitierne Portie (LP).
This research is a normative legal research, which involves library research and field research. The library research was conduted by collecting data from relevant literatures and the field research was carried out by direct observasion in the field to obtain concrete data related to the subject under study. All the data from library research and field research were analyzed qualitatively, producing descriptive data.
With the issuance of Nieuwe Chinezen Wetgeving (new legislation for the ethnic Chinese) by the Ducth East Indies government, the Civil Code for the ethnic Chinese was put into effect in spite of differences in the genealogical system, cultural values and religious beliefs of the community, which brought about difficUlties. The majority of the Chinese in Banyumas Regency could not distinguish between procedures under the Chinese adat law and those under the Civil Code so that in practice there was a combination between the two procedures in division of inheritance without causing much conflict. In case of conflict, they preferred an out of court settlement because it was quicker, less costly and it did not cause familiar break-ups.
