| description | The research on general agency contract as the legal protection for the national marine transportation company as the general agent for foreign ships is the one adopting juridical normative approach, the aim of which, is to know whether the given right and responsibility as the result of contractof general agency between the foreign marine transportation company and national marine transportation has legal protection which is fair for the two parties and how the dispute settlement as the impact of the failure to act according to the letter of appointment or the agency agreement.
This research focuses on the library research employing the documentary study equipment for purpose of obtaining the secondary data and the field research is also done to complete the collected secondary data. The sampling technique adopted is a non probability sampling in the form of purposive sampling, using interview as an instrument to collect the primary data. The form of the interview guidance is made variously between structured and unstructured type. The above data were analyzed by using qualitative analysis producing analytical descriptive data.
The result of the research give general and sytematic description that: (1) The given right and responsibility as the result of general agency appointment to the national marine transportation company by the foreign marine transportation company has been done relatively well, and fulfilling the sense of fairness among the two parties.The euidence is that the two parties implement the content of the contract based on the principle of fairness.This condition has existed since the preparation stage for the contract arrangement, which consists of the pre-contractual stage (good faith in subjective sense) and the contractual stage (good faith in objective sense).The written contract has given legal protection for the general agent.The legal protection is preventive in nature and (2) The existing dispute as the result of the failure to act according to the general agency contract only arises from the written contract as covered in the letter of appointment. The dispute settlement in the form of legal protection having repressive characteristics and which is done by way of non-litigation |
