This was a juridical empirical research conducted at the PT. PLN (Persero) WKSKT- Sector Barito Banjarmasin. The research involved literature review and field study. Both primary and secondary gathered were qualitatively processed and descriptively presented by describing and explaining them in relation with problem to study.
Results of this research showed that in the implementation of outsourcing joint contract, workers merely had legal relationship with outsourcing company based on Written Work Contract, both PKWT (Fixed Term Working Contract) and PKWTT (Non-fixed Term Working Contract) as well. Since workers had legal relationship with outsourcing companies only, then user companies were not responsible to outsourced workers. The responsibilities of outsourcing companies involve to fulfill all of workers' rights such as wqges, welfares and working requirements. This was not optimally performed because of the minimum knowledge level of workers on their rights and companies' reluctance to fulfill all responsibilities on workers. Legal protection on outsourced workers were only provided by the outsourcing companies as recruiters, while workers were obligatory to comply with the working regulations of user companies.
